1. Acceptance of Terms
By downloading, installing, or using the ChefBear mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and ChefBear ("we," "us," or "our"). We may update these Terms from time to time; material changes will be communicated through the app or other appropriate means. Continued use after changes constitutes acceptance.
2. Service Description
ChefBear provides the following features and services:
- Menu Scanning: Use your device camera to capture and digitize restaurant menus.
- AI Dish Recognition: Automatic identification and description of dishes from scanned menus using artificial intelligence.
- Personalized Recommendations: AI-powered suggestions based on your preferences, dietary needs, and dining history.
- AI Image Generation: Illustrative, AI-generated images of dishes to help you visualize menu items before ordering.
- Ordering Assistance: Tools to help you organize and communicate your order.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes.
3. Account Registration & Security
To access certain features, you may need to create an account. When you do, you agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security and confidentiality of your account credentials.
- Promptly update your information if it changes.
- Accept responsibility for all activity that occurs under your account.
- Notify us immediately of any unauthorized use of your account.
You may register using third-party sign-in services (e.g., Apple Sign-In, Google Sign-In). Your use of those services is subject to their respective terms and privacy policies.
We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period, with prior notice where practicable.
4. Subscription & Payment
ChefBear offers both free and premium subscription tiers. Premium features require an active paid subscription.
- Billing: All subscriptions are managed and billed through the Apple App Store or Google Play Store. We do not directly process payment information.
- Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.
- Cancellation: You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; you will retain access to premium features until then.
- Refunds: Refund requests are handled by the Apple App Store or Google Play Store in accordance with their respective refund policies.
- Price Changes: We may change subscription prices. You will be notified in advance and must agree to the new price to continue your subscription.
- Free Trial: If offered, free trial terms will be disclosed at sign-up. Your payment method may be charged at trial expiration unless you cancel beforehand.
5. AI-Generated Content
Important: AI-generated images and descriptions in ChefBear are illustrative only. They are not photographs of actual dishes and should not be relied upon for dietary, medical, or allergen decisions.
By using AI features, you acknowledge and agree that:
- AI-generated dish images are artistic illustrations, not photographs. Actual dishes may differ significantly in appearance, portion size, ingredients, and presentation.
- All AI-generated content is clearly labeled as such within the app.
- AI-generated descriptions and recommendations are not medical, dietary, or nutritional advice. Do not rely on them for allergy, intolerance, or dietary decisions. Always confirm ingredients and allergens directly with the restaurant.
- AI outputs may contain inaccuracies, and you assume responsibility for any decisions made based on AI-generated content.
- We continuously work to improve accuracy but cannot guarantee that AI outputs will be error-free.
6. Intellectual Property
Our Intellectual Property
The Service, including its design, software, text, graphics, logos, icons, and AI models, is owned by or licensed to ChefBear and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.
AI-Generated Images — Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use AI-generated dish images created through your use of the Service for personal, non-commercial purposes only. You may not:
- Use AI-generated images for commercial purposes without our prior written consent.
- Represent AI-generated images as real photographs.
- Remove or alter any AI-generated labels or watermarks.
- Use AI-generated images to mislead others about the nature of actual dishes.
User Content
You retain ownership of content you create and upload (e.g., saved menu scans, notes). By using the Service, you grant us a limited license to process your content solely as necessary to provide and improve the Service.
7. User Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Attempt to reverse-engineer, decompile, or disassemble the Service or its AI models.
- Interfere with or disrupt the Service or its infrastructure.
- Use automated means (bots, scrapers) to access the Service without our permission.
- Impersonate any person or entity, or misrepresent your affiliation.
- Upload or transmit malicious code, viruses, or harmful content.
- Circumvent or attempt to circumvent any access controls, rate limits, or security measures.
- Use the Service to generate content that is illegal, harmful, defamatory, or infringes third-party rights.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the maximum extent permitted by applicable law:
- We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not guarantee the accuracy, completeness, or reliability of any AI-generated content, dish descriptions, images, or recommendations.
- We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.
- We are not responsible for the accuracy of restaurant menus, prices, availability, or the quality of food served.
- The Service is not a substitute for professional medical, dietary, or nutritional advice.
Note: Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, the above exclusions apply only to the extent permitted by law. Nothing in these Terms affects your statutory rights as a consumer that cannot be waived or limited by contract.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- In no event shall ChefBear, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses.
- Our total aggregate liability for all claims arising out of or relating to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or USD $50, whichever is greater.
- We shall not be liable for any damages arising from your reliance on AI-generated content, including but not limited to allergic reactions, dietary issues, or food-related illness.
Note: Some jurisdictions do not allow limitations on incidental or consequential damages or caps on liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law. These limitations do not exclude liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
10. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless ChefBear and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
- Your use of the Service or any violation of these Terms.
- Your violation of any third-party rights.
- Any content you submit or transmit through the Service.
- Decisions you make based on AI-generated content.
Note: This indemnification clause may not apply or may be limited in jurisdictions where consumer indemnification obligations are restricted by law.
11. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion, with notice where practicable. You may stop using the Service and delete your account at any time.
Upon termination:
- Your right to use the Service ceases immediately.
- We may delete your account data in accordance with our Privacy Policy retention schedule.
- Provisions that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and governing law) will remain in effect.
12. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with applicable law. We acknowledge that you may be entitled to protections under the mandatory consumer protection laws of your country of residence, and nothing in these Terms is intended to override those protections.
In the event of a dispute, we encourage you to contact us first at chefbearsupport@icloud.com to seek an informal resolution. If informal resolution is unsuccessful:
- You may have the right to bring a claim in the courts of your country of residence.
- Where applicable, you may also use alternative dispute resolution (ADR) mechanisms available in your jurisdiction.
13. Severability & Entire Agreement
Severability: If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and ChefBear regarding your use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
